With the blue sky and the arrival of sunny days, everyone has only one desire: to sit on the terrace to enjoy the first rays of sunshine and a glass of rosé (with ice cubes).

What does the law say?

In terms of regulations, the law is very strict regarding the installation of outdoor seating areas in front of businesses. A temporary occupancy permit (AOT) for the public domain is mandatory for businesses wishing to occupy a portion of the sidewalk that is normally reserved for pedestrians. This permit must meet the conditions set by the administrative authority responsible for its management, which is generally the municipality. The AOT takes the form of a decree and entails the payment of a fee, the amount of which varies depending on the duration of operation, the commercial value of the street occupied, and the size of the outdoor seating area.

It should be noted first of all that only owners of commercial premises located on the ground floor and open to the public can obtain a permit for a terrace or display. This permit is personal (cannot be sold), temporary (valid for a fixed period) and revocable (can be withdrawn at any time).

There are three types of terrace:

  • The open terrace: must be attached to the front of the establishment. It must be furnished with tables and chairs.
  • The terrace: must be located at the edge of the sidewalk
  • The enclosed terrace: A permit application is required for this. The elements must be removable within 8 hours.

Conditions to be met:

  • Pedestrians must be able to move around without inconvenience, especially people with reduced mobility.
  • The peace and quiet of the neighborhood must be preserved.
  • Hygiene rules must be respected (especially for foodstuffs).

What should the application for an AOT include?

  • A copy of the certificate of registration in the trade register or register of trades (Kbis extract);
  • A copy of the license in the name of the owner or operator of the business for beverage retailers and restaurateurs;
  • A copy of the commercial lease or the title deed;
  • Proof of insurance for the occupation of public property;
  • The description of the terrace or display and the materials used, generally a dimensioned plan specifying the location of the device on the sidewalk;
  • A bank account statement…
