What Does the Law Stipulate?
In terms of regulation, the law is very stringent regarding the setup of terraces outside commercial premises.
A temporary occupation permit (AOT) for public land is mandatory for professionals wishing to occupy a portion of the sidewalk, which is primarily reserved for pedestrians. This permit must comply with the conditions set by the administrative authority responsible for its management, typically the municipality. This AOT is issued as a decree and requires the payment of a fee, the amount of which varies based on the duration of operation, the commercial value of the occupied public space, and the size of the terrace.
It should first be noted that only owners of commercial premises, located on the ground floor and open to the public, can obtain a permit for a terrace or display. This permit is personal (cannot be sold), precarious (valid for a determined period), and revocable (can be withdrawn at any moment).
There are three types of terraces:
- The open terrace: must be directly adjacent to the establishment's storefront. It must be furnished with tables and chairs.
- The counter-terrace: must be located at the edge of the sidewalk.
- The enclosed terrace: This requires a specific application for a road occupancy permit. The components must be demountable within 8 hours.
Conditions to be met:
- Pedestrians must be able to circulate without hindrance, especially those with reduced mobility.
- The tranquility of the neighborhood must be preserved.
- Hygiene regulations must be observed (especially concerning foodstuffs).
What must the AOT application file include?
- A copy of the certificate of registration in the commercial register or trades register (Kbis extract);
- A copy of the license in the name of the owner or operator of the commercial premises for beverage retailers and restaurateurs;
- A copy of the commercial lease or the title deed;
- The insurance certificate for the occupation of public land;
- The description of the terrace or display and the materials used, typically a dimensioned plan specifying the placement of the setup on the sidewalk;
